Harsh Penalties Avoided for Man Charged with Driving Under DUI Suspension

If you are charged with driving under the influence and refuse to consent to a breathalyzer test in Illinois, you will most likely have your driver’s license suspended while your DUI case is pending. If you are then caught driving while that DUI suspension is in effect, you will face some very unsympathetic consequences. For example, Chicago DUI defense lawyer Michael O’Meara was representing a man for a DUI offense, but he found himself in another tough legal spot when he was arrested again for driving under a DUI suspension. The man quickly learned that in addition to the penalties for driving under the influence, if convicted of this latest lapse in judgement, he’d also face a prolonged two-year license suspension and a mandatory minimum 5 days in jail or 30 Days of SWAP (Sheriff’s Work Alternative Program), which is an intense form of community service with the Sheriff’s Department.

To hopefully avoid these drastic repercussions, the man discussed his compounded legal problems with attorney O’Meara, who began going over his available options. This resulted in O’Meara meeting with the prosecutor where he successfully convinced him to dismiss the driving under suspension charge outright. This effectively removed the client’s fear of these added penalties, so he could solely focus on the original DUI.
